ACCOUNT REGISTRATION

All users will need to register for an account on www.vowchervault.com before they are able to buy or sell any e-gift cards through the platform. In order to register for an account, users will be asked to submit some personal information about themselves as well as a unique username and password. For more information on the ways in which we handle such personal information, please make sure you also read our privacy policy along with these terms and conditions.

When a user’s registration for an account on www.vowchervault.com has been successful, they will be able to log in and use this as a portal to make, edit and track all of their orders which they have made with www.vowchervault.com. Users are only permitted to make one account per person.

Please be advised that we reserve the right in our sole discretion to revoke or terminate a member’s account at any time if we suspect that the buyers or sellers of e-gift cards operating this account has violated any of these terms and conditions.

HOW TO BUY E-GIFT CARDS

All of the gist cards sold on www.vowchervault.com are e-gift cards and can be redeemed digitally either in-store or online for the designated retailer or brand.

Registered users are able to browse our full selection of e-gift cards which we have available, and purchase these directly through the website with all payments being processed via visa debit or Mastercard payment cards.

When the transaction has been successful then the customer will be sent an email which will contain a link with instructions on how to download the e-gift card. All deliveries are expected to be instant, and there are no shipping or handling fees, however if it has been more than 24 hours and you have still not yet received your gift card from us, then please get in touch with a member of the team and someone will come back to you as soon as possible.

It is mutually agreed between the user and www.vowchervault.com as the seller of the gift cards that all sales are final, and apart from the limited circumstances outlined in this document we are unable to offer returns or refunds for any of the e-gift cards which have been purchased through www.vowchervault.com.

REFUNDS

Refunds will only ever be considered in the following rare circumstances:

• If the funds which have been made available to you on the gift card appear to be less than what you originally agreed when placing the order.
• If the gift card you have purchased is invalid or has expired
• If the gift card is not for the right retailer or brand

Please be advised that www.vowchervault.com will only be able to consider claims for refunds when these have been sent to us within 10 days of the purchase being completed.

If we decide that you are entitled to a new gift card or refund, then we will aim to process this for you on your behalf within 10 working days.

CANCELLATION

Due to the instant and digital nature of e-gift card delivery, once an order has been placed and payment has been successfully processed, the order cannot be cancelled by the buyer. This is because the e-gift card is typically issued and delivered within a very short timeframe following purchase.

If you wish to cancel an order, you must contact us immediately after placing it. We will use reasonable efforts to cancel the order, but we cannot guarantee cancellation once the gift card has already been issued or dispatched to you.

For sellers, an offer to sell a gift card may be withdrawn or cancelled at any time before the gift card and accompanying documents have been sent to www.vowchervault.com and the sale has been confirmed. Once the gift card has been received and authenticated by our team and payment has been agreed, the sale is final and cannot be cancelled by the seller.

We reserve the right to cancel any order or sale, at our sole discretion, at any time prior to completion — including where we suspect fraudulent activity, where the gift card details provided are incorrect or invalid, or where we are unable to verify the identity or ownership of the seller. In such cases, any payments made will be refunded in accordance with our REFUNDS section above, where applicable.

HOW TO SELL E-GIFT CARDS

All users looking to sell gift cards through www.vowchervault.com will need to register with an account on the website before they are able to do so. Any users looking to sell unwanted e-gift cards through the website will need to confirm that they are the owner of the gift card and that they will agree to transfer the complete rights and ownership of the gift card over to www.vowchervault.com upon the sale.

Once a deal with www.vowchervault.com has been agreed for the fee for the gift card which is being sold, the gift card and all accompanying documents shall then be sent to www.vowchervault.com. Once the gift card has been authenticated by the team at Vowcher Vault, the agreed monies shall be sent to the seller within two to three working days.

When a user submits an offer to sell a gift card through www.vowchervault.com then at the same time they must also provide valid payment information as well as any identify checks which Vowcher Vault may ask for in their sole discretion.

Any users wishing to sell e-gift cards through www.vowchervault.com must also guarantee the following:

• That the gift card is valid
• That the gift card contains the correct balance and is for the right brand
• That they are able to release all ownership rights to the gift card
• That the gift card shall be fully transferred to new owners
• That they are the sole owner of the gift card

It shall be mutually agreed between both parties that not all offers for gift cards shall be accepted, and in the event that Vowcher Vault suspects that there could be any unlawful activity which relates to the sale of the gift card then they may in its sole discretion forbid the sale of the gift card.

MAKING PAYMENTS

It shall be agreed that whenever a user makes a payment on this website then the user is giving www.vowchervault.com permission to use the payment information that they have provided as part of their account registration.

All payments – for both buying and selling gift cards – are processed securely through a third-party payment provider. For more information on the ways in which we handle secure information such as your payment information – please also see our privacy policy.

The following billing descriptor VVOB, UAE will display as a billing descriptor upon successful payment.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Vowcher Vault, ORBINEXA FZE, and their respective affiliates, officers, directors, employees, agents, suppliers, and service providers shall not be liable for any indirect, incidental, special, consequential, or speculative losses or damages arising from or in connection with your use of the website or services. This includes, without limitation, loss of profits, loss of business, loss of revenue, loss of anticipated savings, loss of data, loss of goodwill, or business interruption.

To the fullest extent permitted by applicable law, we make no representations or warranties, express or implied, regarding the website, its availability, or the gift cards made available through the platform, including warranties relating to merchantability, fitness for a particular purpose, accuracy, quality, reliability, availability, or non-infringement.

We do not guarantee that the website or services will always be available, uninterrupted, secure, or free from errors, or that any particular gift card will remain available for purchase.

While we take reasonable steps to verify gift cards offered through Vowcher Vault, we cannot guarantee that every gift card will be accepted by the relevant retailer or brand in every circumstance. Users should also ensure that they comply with any applicable terms, conditions, restrictions, or expiry dates imposed by the relevant retailer or gift card issuer.

Nothing in these Terms shall exclude or limit our liability for any matter which cannot legally be excluded or limited under applicable law.

Subject to the foregoing, our total aggregate liability to you for any claim arising out of or in connection with your use of the website, purchase or sale of a gift card, or the services provided by Vowcher Vault shall not exceed the total amount you paid to Vowcher Vault for the specific gift card or service giving rise to the claim.

Indemnity and Liability

You agree to indemnify and hold harmless Vowcher Vault, ORBINEXA FZE, and their respective affiliates, officers, directors, employees, agents, suppliers, and service providers from and against any claims, losses, liabilities, damages, costs, and reasonable legal fees arising out of or in connection with:

• your breach of these Terms;
• your misuse of the website or services;
• any fraudulent, unlawful, or unauthorised activity carried out through your account;
•any gift card submitted or sold by you which is invalid, fraudulent, stolen, unauthorised, or otherwise in breach of these Terms; or
•your violation of any applicable law, regulation, or third-party rights.

This indemnity shall apply to the extent that the relevant claim, loss, liability, damage, cost, or expense results from your acts, omissions, or breach of these Terms.

Term and termination

Users agree that the owners and operators of Vowcher Vault may terminate, revoke, or suspend your account at any time or your use of these services for any reason which we may believe represents any violation of these terms and conditions.

We also reserve the right to block your name and email address from any future use. Any termination of your access to our services could happen at any point and without prior warning.
